1. Introduction

Kimberley Driving School (“KDS”, “we”, “us” or “our”) provides training and related services, including learner booking assistance, theory support, video training, simulator training and driving lessons. Because our business primarily supplies services, bookings, appointments and study materials, this policy mainly deals with refunds, cancellations, transfers, forfeiture, rebooking fees and course validity, rather than the return of physical retail goods.

By paying for, booking or using any KDS course or service, you agree to this Refunds and Returns Policy together with our Terms and Conditions.

2. No Traditional Product Returns

KDS does not operate as a retail store for general goods. For that reason, standard product “returns” do not usually apply. Where physical or digital study materials have already been issued, opened, sent, provided electronically, printed, allocated or used, the value of those materials may be deducted from any refund due.

3. Correct Course Selection

Clients must ensure that they select the correct code, course and package according to their needs before making payment. KDS specifically records in both agreements that clients must make sure they have chosen the correct course and code.

4. General Refund Principles

Refunds are handled and processed by Kimberley Driving School directly. KDS does not promise a full refund in every case. Refund eligibility depends on the type of service purchased, the timing of the cancellation, whether study material has already been supplied, whether lessons or transport have already been used, whether appointments have already been arranged, and whether the package has expired or been terminated.

Any approved refund may take up to 15 working days to be processed.

5. Standard Course Cancellations

For KDS standard training courses, the service agreement states that if a course is cancelled completely, the cancellation should be done within 7 days. If not cancelled within that period, a 30% cancellation fee of the course total may be charged.

In addition to the cancellation fee, the following may also be deducted from any refund on standard courses:

  • R950 for electronic, WhatsApp or printed study material already provided; and
  • lessons already used, charged at the standard out-of-bundle rate of R395 per hour.

6. Book Test Learners Service Cancellations

For the Book Test Learners service, KDS states that:

  • no full refunds are processed as a general rule;
  • if the course is cancelled, there will be a maximum 30% cancellation fee; and
  • a minimum of R400 will be deducted for study material provided.

Any approved refund for this service may also take up to 15 working days to process.

7. Non-Payment Courses and Instalment Defaults

For monthly instalment courses, KDS states that instalments must be paid in consecutive months and within 30 days of each other. If a payment is missed, the course may automatically terminate on the system. The agreement further states that no full refunds will be made on non-payment courses, and a package reactivation fee of R1,500 will apply once a course has terminated.

Where a course has been terminated because of missed instalments or non-payment, KDS may suspend services, cancel future scheduling and decline refund requests except where required by law.

8. Transfer of Ownership Instead of Refund

KDS allows a transfer of ownership from one applicant to another if the original applicant is unable to complete the course. This option is specifically mentioned in both agreements and is also suggested where the applicant relocates.

Any transfer remains subject to KDS approval and may only be done once the account is in order and the replacement applicant is suitable for the package concerned. This gives clients an alternative to full cancellation where a refund may be reduced or unavailable.

9. Course Validity and Expiry

9.1 Standard training courses

KDS states that standard courses are valid for a maximum of 6 months from the date of registration. If a course has not been active for more than 6 months, it may automatically expire without further notice, and monies paid may be forfeited.

9.2 Book Test Learners service

KDS states that the Book Test Learners service is valid for a maximum of 3 months from the date of registration. After 3 months, the service may expire without communication and monies paid may be forfeited.

Because of this, no refund will usually be available for expired courses or services that lapse due to inactivity by the client.

10. Learner Transport, Missed Appointments and Rebooking Fees

Where a learners service includes transport and appointment support, missed transport or missed appointments may lead to loss of the included attempt and extra rebooking costs.

For the Book Test Learners service, KDS states that if the learner appointment transport is missed, the client forfeits that attempt completely, and a transport fee of R550 will be charged for a new transport and booking opportunity.

For the Christiana / Hopetown learner test appointment and transport arrangement recorded in the standard service agreement, KDS states that if the client misses the learner transport or fails the learner test, a rebooking fee of R999 is payable. This fee includes fuel, transport, appointment and issue fee.

These missed-attempt, rebooking and transport-related charges are generally not refundable, as they arise from a missed or unsuccessful booking opportunity already allocated to the client.

11. Lessons That May Be Forfeited

Certain lessons or bookings may be forfeited rather than refunded if the client does not comply with KDS operational requirements.

KDS states that:

  • original learners licence documents must be brought to each lesson where required, and if not, the lesson may be forfeited;
  • driving lesson cancellations must be made at least 48 hours in advance, failing which the lesson may be forfeited due to diary availability; and
  • clients must confirm scheduled lessons at least 48 hours before the lesson, and must report 20 minutes early, with no late coming.

Lessons forfeited because of late cancellation, non-attendance, lateness, missing documents or failure to follow booking requirements are generally not refundable.

12. Study Materials, Digital Content and Training Resources

Where KDS has already issued study materials, manuals, printed content, WhatsApp study support, app-related guidance, or other training resources, the cost or value of those materials may be deducted before any refund is processed. KDS expressly records:

  • R950 for standard-course study materials; and
  • a minimum of R400 for study material in the Book Test Learners service.

If material has already been sent, supplied, printed, or allocated, no return of that material is required before the deduction is applied.

13. Services Already Used

If any part of a course has already been used, including lessons, training sessions, test preparation, transport, or admin support, KDS may deduct the value of those services from any refund due. For standard courses, lessons used are deducted at R395 per hour.

Where third-party bookings, transport or test-related arrangements have already been made, KDS may also refuse or reduce a refund because that portion of the service has already been committed.

14. Rescheduled Trips and Appointments

KDS states that all trips and appointments are DLTC dependant and may be cancelled or rescheduled according to information received from the testing stations. This means KDS may need to move or reschedule bookings due to testing-station changes, availability or operational circumstances.

Where a booking is rescheduled by KDS because of DLTC or operational reasons, KDS will usually attempt to rebook or reschedule rather than treat it as a refundable cancellation.

15. How to Request a Refund

To request a refund, cancellation or transfer, the client should contact KDS directly and provide enough information for the request to be assessed, including:

  • full name and surname;
  • contact number;
  • course or package booked;
  • date of registration or payment;
  • proof of payment; and
  • reason for cancellation or refund request.

Proof of payment must be sent to 061 868 3072 or info@kbydriving.co.za to be allocated.

KDS may request additional information before processing or approving any refund.

16. Contact Detail Changes

KDS states that it must be informed if contact details change, and if it is unable to contact the client, it may not be able to proceed with the course.

KDS will not be responsible for missed bookings, expiries, or lost opportunities caused by the client’s failure to update phone numbers, WhatsApp details or other contact information.

17. No Guarantee of Passing or Refund for Test Outcomes

KDS requires learners and drivers to study, prepare, complete compulsory assessments and pass required practice or theory tests before progressing. The agreements make clear that studying and preparation remain the client’s responsibility.

For that reason, failing a learner or driver test does not automatically create a right to a refund. Instead, rebooking fees, additional lessons or further preparation may apply depending on the package and the circumstances.

18. Complaints About Service Quality

If a client is not fully satisfied with the quality of the service received, KDS asks that the issue be raised with Mr or Mrs Kotze immediately, because KDS cannot address an issue if it is not aware of it.

Raising a complaint does not automatically create a right to a refund, but KDS may investigate the matter and decide on an appropriate remedy depending on the circumstances.

19. Policy Changes

KDS may update this Refunds and Returns Policy from time to time. The latest version published on the website will apply from the effective date shown on that version.
